Amical Wikimedia/General Assembly resolution (15/03/2012)

Catalan version

Des de la Trobada fundacional a la Biblioteca de Catalunya es va plantejar que la nostra associació fos reconeguda internacionalment per la Wikimedia Foundation.

Aquest reconeixement ha seguit un procés complex -donada la peculiaritat de la nostra proposta- i donat que només estava previst el reconeixement d'associacions estatals o subestatals.

Des de bon començament ens varem plantejar com a punts imprescindibles:

1. Que el nostre àmbit d'actuació havia de ser com a mínim tots els territoris de parla catalana.
2. Que la col·laboració amb altres associacions estatals havia de ser en pla d'igualtat, sense cap mena de subordinació de ningú vers l'altre.
3. Que el nostre reconeixement havia de comportar poder promocionar els projectes en català amb les mateixes eines i la mateixa llibertat que tenen les associacions estatals.

També varem definir des del començament que hi havia un parell de característiques de les associacions estatals que no només no teníem necessitat de tenir sinó que fins i tot veiem negatives i perjudicials. Per tant, no només no ens importava no tenir-les sinó que fins i tot rebutjàvem:

1. L'exclusivitat territorial. Pensem que és contradictòria amb la cultura del coneixement lliure i és contradictòria amb la cultura catalana. La societat catalana és una societat oberta i d'acollida. Casa nostra és casa de tots. Tothom qui vulgui promocionar el coneixement lliure a les nostres terres serà benvingut i rebrà el nostre aplaudiment i si és al cas el nostre suport sense necessitat d'associar-se amb nosaltres.
2. El nom "National Chapter". Aquest nom té una connotació política que no beneficia en res el moviment del coneixement lliure i que el pot perjudicar en molts casos. El coneixement lliure ha de ser fonamentalment respectuós amb la llibertat de la gent i la seva voluntat lliurement expressada. Només ens convé entrar en afers polítics si es tracta de legislacions que afecten al desenvolupament del coneixement lliure i la seva expansió.

AL llarg d'aquests anys hem anat aconseguint explicar la nostra proposta i que hagi estat entesa cada vegada per més gent dins del moviment viquimedista. Ha rebut més de 520 suports d'editors de la Viquipèdia de llengües molt diverses i també ha rebut el suport de 11 institucions del món de la cultura i el coneixement. En aquests moments la Junta directiva de la Fundació Wikimedia s'ha proposat aprovar una resolució per reconèixer organitzacions amb característiques com la nostra.

Al mateix temps a la trobada de París d'enguany juntament amb les associacions estatals hem proposat de crear un consell o agrupació d'associacions per tal de coordinar-nos donar-nos suport mutu, establir mecanismes de rendició de comptes i formar una veu conjunta.

En aquest procés hi ha hagut moltes persones que ens han entès, ens han donat el seu suport i la seva ajuda. Els haurem d'estar agraïts a totes però algunes s'han significat de forma especial i per tant mereixen un agraïment i un reconeixement especial.

Per últim un dels factors que han estat debatuts en aquest procés és el del solapament en el mateix àmbit geogràfic de diverses associacions promocionant la Viquipèdia i els projectes germans. El sol fet de ser reconeguts i per tant de tenir accés als fòrums internacionals ens permet accedir a canals de comunicació per coordinar aquestes activitats. Però previsiblement hi haurà oportunitats singulars de desenvolupar activitats en coordinació amb les associacions espanyola, francesa i italiana. Per tant té sentit preveure l'obertura de vies de col·laboració singulars amb aquestes associacions.

Per tot això es proposa a l'assemblea d'aprovar les següents resolucions.

Resolucions

Aquestes resolucions s'han d'entendre com una unitat que té sentit en la mesura que es duen a terme conjuntament.

Presentar-nos a la nova fórmula d'afiliació de "Partner Organization"

Tan bon punt com la Junta de la WMF aprovi la resolució amb els nous models d'entitats afiliades d'acord amb el model publicat:

Autoritzar a la junta directiva a presentar la candidatura d'Amical en l'àmbit de la cultura i la llengua catalanes amb el nom de Wikimedia CAT i a entrar en negociacions amb la WMF per signar el corresponent contracte.

Participació com a membre de ple dret en el "Chapters Council"

D'acord amb l'article 10 e) dels estatuts és competència de l'Assemblea General la decisió d'incorporar-se a unions d'associacions o separar-se'n.

Per la present s'autoritza al president a incorporar l'associació al Chapters Council com a membre fundador de ple dret i a negociar l'estructura detallada d'aquesta entitat.

També se'l autoritza a proposar que la seu d'aquest nou organisme s'estableixi a Barcelona.

Autorització per obrir canals de comunicació privilegiats amb WMES, WMFR i WMIT

S'autoritza a la junta directiva a obrir canals de comunicació privilegiats amb WM-ES, WM-FR i WM-IT. Aquests canals de comunicació podran incloure:

• Programes de trobades presencials coincidents prèvies o posteriors a les trobades internacionals -com el Chapters meeting de Berlín o de Wikimania- així com reunions bilaterals o multilaterals organitzades ad-hoc.
• Una llista de correu privada on hi puguin accedir membres escollits per aquestes entitats.
• Accés a les llistes i les parts privades de la wiki de la associació.
• Presència amb veu però sense vot a les assemblees presencials.

Aquests canals de comunicació s'hauran d'anar obrint de manera progressiva a mesura que els projectes de col·laboració ho justifiquin i a mesura que es vagin construint vincles de confiança entre aquestes entitats.

En qualsevol cas el tracte sempre haurà de ser totalment simètric i qualsevol obertura haurà de tenir exactament la mateixa contrapartida per l'altre banda de forma que quedi clar que la relació és sempre de igual a igual.

Autorització per fer pública aquesta decisió d'assemblea

Tots i cadascun dels punts d'aquesta resolució d'assemblea -per poder-se dur a terme- necessiten l'acord d'altres entitats germanes del moviment viquimedista i formen part d'un conjunt únic.

Per tant s'autoritza a fer pública aquesta resolució de forma que pugui ser acceptada com a un tot per part de cada una d'aquestes terceres entitats.

English translation

Since the founding meeting at the Library of Catalonia it was proposed that our association could be recognized internationally by the Wikimedia Foundation.

This recognition has taken a complex process, given the peculiarity of our proposal, and given that WMF only had regulated the recognition of national and sub-national organizations.

From the beginning we set as essential points:

1. That our scope was to be at least all the Catalan-speaking territories.
2. That collaboration with national associations should be on equal footing, without any subordination of one towards another.
3. That our recognition would lead to promote projects in Catalan with the same tools having and the same freedom that the national associations have.

We also defined from the beginning that there were a couple of features of the national associations that not only we do not need but that we see even as negative and harmful. So not only do we care about them but even reject having them:

1. The territorial exclusivity. We think it is contradictory to the culture of free knowledge and is contradictory to the Catalan culture. Catalan society is open and welcoming. Our house is home to all. Everyone who wants to promote free knowledge to our land will be welcome and will receive our applause and our support if it is the case without the need to affiliate with us.
2. The name "National Chapter". In our environment this name has a political connotation that does not benefit at all and free knowledge movement and that can hurt it in many cases. Free knowledge should be essentially respectful with the freedom of people and their freely expressed wishes. All we should go into politics is when it comes to laws that directly affect the development and expansion of free knowledge.

Over the years we have managed to explain our proposal and it has been increasingly understood by more and more people within the Wikimedia movement. It has received support from more than 520 Wikipedia editors of diverse languages and has received support from 11 institutions from the world of culture and knowledge. At present, the Board of the Wikimedia Foundation has approved a proposed resolution to recognize organizations with characteristics such as ours.

While the meeting in Paris this year with the national associations it has been proposed creating a council or group of organizations to coordinate ourselves give us mutual support, establish mechanisms of accountability, and form a united voice.

In this process there have been many people who have understood us, who have given us their support and assistance. Perhaps we should be grateful to all but some have a special meaning and therefore deserve special recognition and gratitude.

Finally one of the factors that have been debated in this process is the overlap in the same geographical area of associations promoting Wikipedia and sister projects. The mere fact of being recognized and therefore have access to international forums allows access to communication channels to coordinate these activities. But presumably there will be unique opportunities to develop activities in coordination with Spanish, French and Italian associations. So it makes sense to anticipate the opening of channels of unique collaboration with these associations.

Therefore it is proposed to the Assembly to approve the following resolutions.

These resolutions must be understood as a unity that makes sense while they are carried out jointly.

Apply for the new affiliation model of "Partner Organization"

As soon as the WMF Board approve the resolution with the new models of affiliated entities in accordance with the published model:

Authorize the board to file the Amical application in the area of Catalan language and culture with the name Wikimedia CAT ant to enter into negotiations with the WMF to sign the corresponding agreement.

Participation as a member of full right in the "Chapters Council"

Under Article 10 e) of our bylaws is the responsibility of the General Assembly to take the decision to join associations and to separate from them.

Hereby authorizes the president to join the association to Chapters Council as a founding member with full rights and negotiate the detailed structure of this entity.

It also authorizes him to propose that the seat of this new organization be established in Barcelona.

Authorization to open privileged communication channels with WMES, WMFR, and WMIT

Authorizing the board to open privileged communication channels with WMES, WMFR, and WMIT. These communication channels may include:

• Programs of face to face meetings prior or subsequent to the international meetings, such as Chapters or Wikimania meeting, as well as bilateral and multilateral meetings organized ad hoc.
• A private mailing list where members chosen by them can access.
• Access to the association private mailing lists and to private parts of the wiki of the association.
• Presence with voice but no vote at General Assemblies.

These communication channels should be opened gradually as the projects of cooperation justified their need and as we build bonds of trust with these entities.

In any case the treatment must always be fully symmetric and any opening should be exactly the same counterparty on the other hand so that it is clear that the relationship is always equal.

Authorization to make public this assembly decision

In order to be carried out each and every point of the resolutions of this Assembly needs the agreement of other sister Wikimedia movement organizations and are part of a unique set.

Therefore it is authorized to publish this resolution so that it can be known and accepted as a whole by each of these third parties.
