Eligibility[edit]

The Wikimania 2016 Scholarship (the “ Program”) is open to individuals who are the age of majority in non-embargoed locations where Program, have been registered users for at least one month on any Wikimedia project, and meet Wikimedia scholarship eligibility criteria provided here at the start of the Program (“Participant”). Must have signed up on the list of participants and sign their contribution to be eligible to win. Void where prohibited. Conducted and administered by The Wikimedia Foundation, Inc., 149 New Montgomery Street, Floor 3, San Francisco, CA 94105 (“Wikimedia Foundation”). Employees, members, officers, directors, agents, representatives of Wikimedia Foundation, the promotion and advertising agencies of any aforementioned entity, the prize provider(s), and each person or entity connected with the production or administration of the Program are not eligible.

Official Terms[edit]

Sponsor makes this Program, including all information, applications, files, text, graphics, software, and audio/visual files (collectively, the "Materials") available for Participant’s use subject to these Rules, the Wikimania Scholarship Guidelines and related terms (collectively, the “Program Terms). In case of inconsistency, these Rules will govern. By accessing, using, or downloading in any way, without limitation, any Materials from this Program, Participant agrees to and is bound by the Program Terms.

International Participants[edit]

Access to this Program from locations where participation in this Program or any of its Materials is illegal is prohibited. If you access this Program from a country not listed as eligible, your entry may be disqualified. In those countries where valid, the Participant is responsible for compliance with all local and/or international laws.

Period[edit]

The Program begins on July 14 at 00:01 UTC and ends on August 23, 2015 at 23:59 UTC (the “Program Period”).

How to enter: Online or In-Person only. One submission per person[edit]

During the Program Period, enter the learning campaign page located at https://meta.wikimedia.org/wiki/Grants:Evaluation/Community_Health_learning_campaign and follow the instructions to sign-up on the Participants’ list and provide input about community health according to the Submission Guidelines below, in the form of a written answer or a drawing (“Submissions”). You may also enter in person by registering and submitting a Submission at the Wikimedia booth located at the 2015 International Wikimania Conference to be held July 15 though 19 at the Hotel Hilton, Mexico City Reforma, Mexico City. You must be registered in order to be considered. Sponsor reserves the right to disqualify any Participant it finds to be tampering with the entry process or the operation of the Program or violating these Official Rules. Submissions will not be acknowledged or returned. Sponsor is not responsible for incomplete, late, lost, delayed, damaged, misdirected, incomplete, void, corrupted, garbled, illegible, or unintelligible submissions and those Submissions are void and will not be accepted; nor is Sponsor responsible for any problems, bugs or malfunctions Participants may encounter when seeking to enter their Submissions. You may not enter with multiple identities or use any automated system, bot or other device or artifice to enter or obtain more than the maximum number of qualified entries. All contact information provided must be truthful, valid and current.

Submission Guidelines[edit]

See Wikimania Scholarship Guidelines and the Wikimania Scholarship page. In addition, Submissions should be positive, authentic and relevant to the Program’s message and should be compatible with Sponsor’s mission and the free knowledge movement. Size limitations may apply to the written response or drawing, according to the instructions on the screen or on site as the time of Submission. All Participants must license their Submissions pursuant to the Creative Commons license Attribution-ShareAlike 4.0 International. To learn more about this license, visit http://creativecommons.org/. You must be the original author of everything in your Submission or have permission to use copyright protected material. So while we want you to be creative, you need to be careful. If you're thinking about using existing text, art, photos or the like, odds are that someone else owns a copyright to that material and you will need to get the copyright owner's permission before using the material in your Submission. By entering, you warrant that your design does not infringe any third party’s rights, and that you have obtained all necessary permissions from all relevant third parties to submit the Submission. If, in the sole discretion of Sponsor, your Submission constitutes copyright infringement, the Submission will be disqualified. Participant must hold all rights to the entire design Submission. Any images contained in any Submission must be used with proper permission. Participant agrees to indemnify Sponsor against any and all claims of infringement from any third party for any use by Sponsor of the Submission. Participants may not be: 1) represented under contract that would limit or impair Sponsor’s ability to use the Submission in any media form; 2) are under a merchandising agreement; or 3) are under any other contractual relationship, including but not limited to guild and/or union memberships, that may prohibit them from participating fully in this promotion, or from allowing Sponsor to use royalty-free, the Submission worldwide in all media in perpetuity.
No Submission may depict any offensive or obscene subject matter as determined in our sole discretion. No Submission shall portray Sponsor in a negative light. We reserve the right to exclude any design that we believe doesn't meet the above criteria, at our sole discretion.

Selection of Scholarship Recipient[edit]

Wikimedia will select one (1) Scholarship recipient (“Selected Recipient”) among all qualified Submissions, based on the relevance and creativity of the Submission and the criteria described on its Scholarship Page. Selected Recipient will be notified by email, telephone, or personal message at the sole discretion of Sponsor or Sponsor’s representative. Selected Recipient will be required to respond (as directed) to the notification within 48 hours of attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize; and, in such case, Sponsor may choose the next highest scoring Submission from among the remaining eligible submissions. Selected Recipients will be required to sign and return a Declaration of Eligibility and Liability/Publicity Release (“Declaration”) and any other documents Sponsor or Sponsor’s representative may require, within 48 hours of receipt of the Declaration. Failure to timely return a signed Declaration or other required documents or the return of any prize notification as undeliverable will result in Prize forfeiture. If a Selected Recipient cannot be reached, is unable or unwilling to accept the Scholarship (or any portion of the Scholarship) or is disqualified for any reason, the Scholarship may be awarded to a runner-up, if any, in Wikimedia's sole discretion. Only three (3) alternate Selected Recipient may be determined, after which the applicable prize will remain unawarded.
Any Submission that is considered by Sponsor in its sole discretion to be obscene, libelous, inapposite to the reputation of Sponsor, or otherwise objectionable or inappropriate, or which otherwise does not comply with these Official Rules will be disqualified. Except as otherwise stated in the Program Terms, personal information collected in connection with this Program will be used in accordance with the privacy policy found at https://wikimediafoundation.org/wiki/Privacy_policy and with the consent given by Participant at the time of entering a Submission.

Prize[edit]

One (1) Wikimedia 2016 scholarship, including round-trip coach class airfare for one (1) person, from a major commercial airport near Selected Recipient’s home, standard accommodations for 3 nights, and registration for the Recipient to attend the conference in Esino Lario Italy in 2016 (“Scholarship”). Travel restrictions, blackout dates, conditions and limitations may apply. Choice of airline(s) and hotel(s) shall be at the discretion of Sponsor. Prize may be awarded in the form of coupon(s), voucher(s) and/or gift card(s). Actual value of travel prizes may vary based on point of departure and airfare fluctuations. Once airline tickets and hotel reservations have been issued, they shall not be changed, re-sold, endorsed, exchanged, transferred or in any other manner modified by Selected Recipient. Travel must be completed by the last day of Wikimania 2016, to be set by orginizing team. Sponsor will make all necessary reservations as needed, unless it indicates otherwise to Selected Recipient. Travel arrangements are subject to availability and to the terms and conditions of the airline and hotel. Selected Recipient solely responsible for any other unspecified expenses and taxes related to the prize and for obtaining all necessary identification and travel documents. No substitution, transfer, or cash redemption of Scholarship, provided however that Wikimedia reserves the right to substitute with another prize of equal or greater value should the advertised prize become unavailable for any reason. If Selected Recipient is unable to participate in or accept the prize or any portion of the prize for any reason, Wikimedia shall have no further obligation to the Selected Recipient. The Scholarship may be a taxable event. Any and all activities related to the prize, without limitation, are at the Selected Recipient’s own risks and subject to whatever restrictions are imposed by the entities that govern activities. Wikimedia’s Travel Rules apply.

Publicity[edit]

By participating, participants agree that Sponsor, its agents and representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors are not responsible or liable for, and shall be released and held harmless from any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Program, or acceptance of the prize, including without limitation, claims based on publicity rights, defamation, or invasion of privacy. Sponsor reserves the right to use the Submissions to the Program for purposes consistent with its mission and the Program’s objectives prior to, during, or after the Program end date, in any media, and to use the name, likeness, hometown name, of any Participant, including all or part of their design throughout the world, in perpetuity, without any compensation or prior review, unless specifically prohibited by law. Participants will not be paid for their Submissions or for granting Sponsor any of these rights. Should any Selected Recipient be unwilling or otherwise unable to provide permissions and or releases or otherwise cannot accept or receive the prize for any reason, the Selected Recipient with the next highest score will be chosen from the remaining entries until one who is able to meet all requirements can be selected.

Privacy[edit]

All personal information collected by Sponsor will be used for administration of the Administration and in accordance with Sponsor’s privacy policy located at: http://wikimediafoundation.org/wiki/Privacy_policy. In addition, Participants may receive email correspondence from, or on behalf of Sponsor, via electronic communication. All personal information will be held on servers located in the United States. Participants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in any email communications received.

General terms[edit]

Wikimedia reserves the right, in its sole discretion, to cancel, modify or suspend the Program should a virus, bug, computer problem, unauthorized intervention or other causes beyond Wikimedia’s control, corrupt the administration, security or proper play of the Program. By participating, Participants agree: (i) to be bound by the Program Terms and the decisions of Sponsor which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Program or these Official Rules, except where prohibited by law. By accepting a prize, Selected Recipient agrees to release Sponsor, including its parent, subsidiary and affiliated entities together with the respective directors, employees, officers, licensees, licensors and agents, and respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Program (collectively, the “Releasees”) from any and all liability, loss or damage arising from or in connection with awarding, receipt and/or use or misuse of prize or participation in any prize-related activities. Releasees are not responsible for computer malfunctions, network connections, email delivery problems, systems failure or incompatibility, typographical, technical or key-stroke errors, or interruptions in your internet service, and for incomplete, illegible, misdirected, misprinted, late, lost, damaged or stolen notifications. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Program. Sponsor reserves the right to cancel or suspend the Program, in its sole discretion, should it receive fewer than 50 entries, or due to circumstances beyond its control, including natural disasters. Submissions will not be returned and may be destroyed. The internal laws of the State of California will govern disputes regarding these Rules and/or this Program. All cases and claims pertaining to this Program must be brought in a court of competent jurisdiction in the City of San Francisco. Wikimedia may prohibit a participant from participating in the Program or winning the Scholarship if, in its sole discretion, it determines such participant is attempting to undermine the legitimate operation of the Program in any way by cheating, hacking, deception, or any other unfair playing practices, or is intending to annoy, abuse, threaten or harass any other participants or Sponsor’s representatives or agents.
