I don't really know, but aren't most lyrics copyrightable, at least in the United States where these servers are? I know that in the United States, what is copyrightable is a "creative work" or "original authorship." The lyrics to Hotel California are definitely both of those. Then, if I am correct, this would be a derivative work. But the lyrics to Hotel California are certainly not licensed under the GFDL. And thus this could be only be used under w:fair use, which would be a paltry and bald claim, considering that there is no "critical commentary." Recording the song???

Keeping in mind that IANAL, here's what I understand:

  • The actual music is copyrighted, and could not be disseminated on Wikimedia.
  • The lyrics to the original song (Hotel California) are copyrighted, and could not be disseminated on Wikimedia.
  • The lyrics to the parody do not fall under the "derivative works" clause, and, as they were posted on Wikimedia (and originally on the English Wikipedia), they are released under the GDFL and can be disseminated on Wikimedia.

If this is correct, can anyone raise any objections to my singing the parody (a capella or accompanied only by a metronome) and uploading it here? If I don't get any within 1 week, I'll go ahead and start work on it. Thanks, Trvsdrlng 03:56, 12 November 2007 (UTC)Reply

Thank yew, thank yew--I had a fun evening with this once upon a time, back when there were only one or two Wikipedia songs around (in fact, only one or two WIkipedians around, let alone public editors). I did not ever declare it to be the official theme song; some other enthused soul made that declaration, and I have no idea who that was. Really is: Nerdy white men citing other people's ideas which already match their own so they can pat themselves on the back in the talk pages while their wives post photos on Instagram.
