Anthere, Hi, I'm not sure if this is the right place for this... but here goes...

Mrmiscellanious has broken these WIKI rules by immediately pulling/editing other's work in an article without first dicussing it on the Talk page. He was supposed to do this as a last resort according the guidelines in the link above. Also, he was not polite in the spirit of WIKINEWS and basically referred to the article as "very, very idiotic".. etc. That is also frowned upon in the WIKINEWS guidelines and it makes me wonder why he even has any administration priviledges.

Now all hell has broken loose, insults were thrown back and forth and the page is locked from editing. Could you please unlock the page and let everyone continue developing the article? I will not try to publish the page myself, but there are others that would like to develop and publish the article as this story grows. I should note that there was some editing beyond my control and mistakes made (like bolding the text) that could influence the NPOV and should be changed. We would have been glad to have made those changes if it wasn't for Mrmiscellanious insulting behavior and heavy-handed, rule-breaking approach to this article in the first place.

But, in the end... I really don't care about what's happened. I'd just like to see this article get developed and eventually published because it's an important piece that I feel will enrich WIKINEWS.

C'est un menteur de la pire sorte, il me dégoûte : il écrit que je l'ai banni (effectivement je l'avais ecrit ainsi dans la première version : banni un jour). Me rendant compte du contre-sens j'ai immédiatement remplacé banni par exclu. Lui cependant, a fait abstraction de cela pour affirmer au monde que je l'avais banni (alors que maintenant déjà, il est libre). Quel culot ! Qui dit que je le soutiens ? Je me contente de dire qu'une personne a parfaitement le droit de s'exprimer sur meta, et que ce n'est parce qu'il t'a ennervé sur wikinews que nous devrions "supprimer" son commentaire sur méta comme tu en as fait la demande ([1]). Maintenant, ce que je te conseille de faire face à un anonyme qui affirme que tu as des puppets, sans pour autant ni dire lesquelles ni prouver ses affirmations, est de tout simplement ne pas en tenir compte et nous laisser juges par nous même. En tous cas, il est parfaitement libre de proposer Wikinews à la fermeture (tu es aussi libre de t'y opposer), il est libre de candidater pour être sysop (tu es libre de voter contre), et même (c'est révolutionnaire) il est libre de modifier tes articles. Bonjour, c'est étrange mais les règles me semblent trés différentes entre la page en anglais et celle en français. En effet, si j'ai bien compris, bien que n'ayant pas de compte sur wikiactualité, je peux voter sur la page de vote en anglais (other), mais ne le peux pas sur la page en français. Sur la page de discussion, ton intervention me semble aller dans le sens d'une consultation ouverte à tous, en effet il y a de fortes chances que je participe un jour à wikiactualité et souheterais donc participer à la consultation... Bizzare ou est-ce mes connaissances en anglais qui me jouent un tour ? J'étais pret à faire les changements mais je voudrais quand même une confirmation. English Wikiquote[edit]

I put a message on your talk but realized you have little chance to see it soon. Would you mind to put a comment about your blocking on q:en:Wikiquote:Village pump? The user in question seems to be a trouble maker on Wikipedia, but on Wikiquote, not. We need a close explamation. Aphaia++

I noticed now your message on his user page. But it is still unclear for me on basis of decision. It seems you mean as if English Wikipedia can apply their decision to other English projects, and it is unacceptable from my view. If you acted on behalf of the Foundation as a Trustee, it is understandable at leat for me. I would like you to make it clear. If you provide no further information within some days, I will unblock him because his activity on Wikiquote is generally benefical to the community; welcoming new users, invitations for registration and clean-ups. I explained in my talk page I did act as a board member (but not on behalf of the foundation). If you want to revert the block or ask Jimbo his opinion, please do so. I stick personnaly to my decision. And will unilaterally block the guy again if he insults editors.

I would prefer that you wait a few days before reverting my block though, so as not to plain dismiss my action, which would remove most of trust editors can put in me being able to help them, and very likely prevent me to do any more similar action in the future to help protect a community or an editor. Note that this case is by many ways similar to what you requested from me one night at 3 am (and which I did without asking approval from the japanese community). Each time you show lack of trust for what a board member does, you also reduce the confidence which might exist in her, and reduce her ability to do anything to fix problems later on. I hope you were aware of this when you questionned my action on the wikiquote pump. It will not be without any consequences. Unfortunately. CheckUser[edit]

Ah, sorry, I forgot to note it on Requests for permission - huwiki has some major problems with sockpuppets and the community has asked stewards to give grin CheckUser access. I wanted to consult the case with some other stewards, due to the lack of a policy ATM. Danny wanted to do it, but the interface was broken. I may be mistaken, but I think Angela also was okay with that. Both me and Grin wanted to catch some other stewards on IRC, but you aren't around lately (at least from what I noticed). Sorry to inform you in such a way - I plan to monitor the CheckUser access list to see how Grin uses the tool. If you want to veto this, go ahead, I won't be mad if you'll take away his status.

Since this is against policy, the minimum thing to do is to list the access given on request for permission. I was on the verge of removing the access. I would recommand that you list the temp access, with a certain amount of time, the link to the place where the community gave its permission and a direct link to the log to check the usage. I don't have the exact link ATM, I'll ask Grin for it tommorow. As for the log, currently it's visible only by users with the CheckUser permission. I hope it'll be made public (for the usernames, that is), but that's another topic. As for the policy, we have Proposed CheckUser Policy - someone needs to work on it, and we need to accept it. Wikiquote de[edit]

Wikiquote en is considering a copyright policy based only on the fair use exception [2]. Avoiding Copyvio Paranoia it is nevertheless clear that according German law (see the chapter Sind Zitaten- und Aphorismensammlungen zulässig, wenn die Texte urheberrechtlich geschützten Werken entnommen werden? in the legal advice here) there is no way to use the fair use argument or the German quotation right (Zitatrecht) for collections of quotations. The problem has been mentioned several times at Wikiquote de and in de Wikipedia - nothing was done. French Wikiquote has no Copyright page and concerning the UK I do not know if fair dealing can legitimate quotation collections (although the servers are in the USA it is IMHO Wikimedia policy to respect the laws of foreign countries). I am :-) Did not immediately answered because not an easy answer. I am aware of the problem. This is indirectly the reason why I started m:How to use or reuse our content. It is also a problem for the japanese wikiquote (not only german and french). I'll report (again) the issue to the board and will see if some lawyers could work on that. I must however tell you that unfortunately wikiquote is not considered a priority in comparison of some of our current legal points to solve... so do not expect any quick solution to that. The French Wikiquote relies on the article L-122-5 part 3 of the French Code de la propriété intellectuelle. It states that the author of a work cannot forbid "3º Sous réserve que soient indiqués clairement le nom de l'auteur et la source : a) Les analyses et courtes citations justifiées par le caractère critique, polémique, pédagogique, scientifique ou d'information de l'oeuvre à laquelle elles sont incorporées".

This explicit quotation right allow fr.wikiquote to build up a database of quotations. But it does not allow fr.wikiquote to copy another quotation database, since this one would be considered as a collective work in itself (an encyclopedia of some sort), and protected by database copyright as well.


I would be very suprised if this was not the case in DE. Is there any english translation of their Law ?

Request for permissions[edit]

Jtkiefer's request for desysopping rested on a partisan interpretation of w:WP:RFAR/SV > w:WP:RFA/SV > w:WP:RFAR/SVRFA etc. If you read it correctly, some of the votes in the oppose column were in fact opposed to the Arbcom's use of the RFA as a solution. IAC the proper proedure for closing was in flux, and as a result the RFA was closed early, with some on both sides complaining about the nature of the RFA as an Arbcom remedy and with the motion to early close. Per the above note, the w:WP:RFA/SV shows a "result [that] differ[s] from before" —i.e. it was overwhelmingly remanded to the Arbcom to make a decision as to my status. Understanding that your decision to not resysop was nominal (See WPt:RFA/Sysop) my status was unchanged by the RFA, and I request that you restore my account (ie. until the Arbcom rules) to correct the desysopping. English version of Wikimédia France bylaws[edit]

Usage rétroactif abusif d'une licence "Domaine public" sur Wikinews[edit]

Certains ont vraiment abusé en la matière. Prenant prétexte des conversations tenues ici ou là avec diverses personnes (participants de Wikinews ou de la Foundation), ils ont estimé que les textes publiés antérieurement au 24 septembre 2005 sur les projets Wikinews devaient être placés d'autorité dans le domaine public.

Il en a résulté, le 1er octobre sur WN-FR, la création d'un modèle:Article Domaine Public, qui a été apposé sur plein de pages dont 79 des articles dont je suis le premier (et principal) contributeur.

Quand on voit en plus comment de quelle manière sale ce modèle était apposé au sein de l'article, on ne peut qu'être effaré. Voir par exemple l'article Les électeurs néerlandais disent à leur tour « non » à la Constitution européenne dans sa version du 3 juin puis dans celle du 1er octobre.

Constatant cela, et pleinement conscient qu'on s'était livré à mon insu à une opération illégale, puisque je n'ai à aucun moment signé le moindre document écrit qui permette de transférer, comme on a pu me le dire entre-temps, mon droit moral d'auteur à une prétendue personne morale (sans existence) Wikinews, qui deviendrait ainsi auteur collectif des œuvres publiées avant le 24 septembre, j'ai :

  1. ajouté sur WN-FR une copie du fr:modèle:Double licence ;
  2. ajouté à ma page utilisateur Wikinews une revendication claire et nette de la double licence pour l'ensemble de mon travail passé et à venir ;
  3. supprimé, dans tous les articles dont j'étais le premier auteur (et principal contributeur), cette aberration du « domaine public » avec à chaque fois, dans la boîte de Résumé, ce commentaire explicite : « retrait de {{Article Domaine Public}}, qui viole le CPI ».

Ça n'a pas manqué de provoquer diverses réactions, chez un ignorant, le sieur Divol, qui a commencé par écrire n'importe quoi, et auquel j'ai répondu assez sèchement

Le sieur Faager ayant entre-temps manifesté l'intention de reverter l'ensemble de mon travail de revendication de licence, je demande le désysopage immédiat de ce personnage, en raison de sa violation caractérisée du droit d'auteur sur 79 articles, inaliénable selon le code de la propriété intellectuelle, la position d'administrateur me semblant incompatible avec la violation de ce droit.

Si la Foundation donne raison à ce personnage, il est clair que je cesserai toute collaboration avec elle, en me réservant le droit de faire appliquer le droit par toutes les voies qui pourraient me sembler nécessaires.

Contacté sur IRC, Solensean a alerté Jimmy Wales, lequel semblerait donner raison aux partisans de cette aberrante licence domaine public rétroactive. Là, je dis non, de toutes mes forces, et me mets en grève illimtée sur l'ensemble des projets dépendant de la Foundation. On ne passe pas ainsi par pertes et profits le droit d'un auteur à être en permanence crédité de son travail, puisqu'attribuer à la pseudo-personne Wikinews ce travail reviendrait à cela. Où va-t-on avec de telles dérives ?

I am working on a presentation for my University (of Pittsburgh) next week - my plan is to teach people about Wikipedia, and make the lecturers use it as a teaching tool. After a month of working on the idea, I just realised that somebody might have done it before (better late then never...) and stumbled upon Presentations. I am now reviewing the available material, incorporating it into my presentation, and I was wondering if you could tell me what those movies are about - downloading them all is something I'd like to avoid. Je n'ai jamais dit que tu m'avais "ordonné" quelque chose. J'ai juste dit que la Foundation était d'accord (et je me suis trompé...).

Requested check of use of checkuser rights[edit]

Anthere, Today I was kicked off and banned from the #Wikipedia IRC channel by Kelly Martin. If you want the details of why, I am quite willing to explain, but I don't believe it is central to the point at hand. I have reason to suspect that Kelly Martin may have used her checkuser rights in order to identify what account I was using on IRC #Wikipedia, as no one else was booted off the channel prior to my being booted. I've never identified my IRC nick with my Wikipedia nick prior to this incident. With 200+ users on the channel, such accuracy in booting me seems...suspect. I would like a check to be done to determine if Kelly Martin ran a checkuser request against my en.wikipedia.org ID "Durin". Durin, I acquired your IP address through an email you sent me some time back. Hotmail discloses the IP address of the sender in the message headers. I promised you, some time back, that I would not use my CheckUser privileges to determine your IP address; such use would be a gross abuse of that authority. I did not use CheckUser for that purpose, and I authorize Anthere, or any other individual with access to the CheckUser log, to publicly verify that the foregoing statement is true.
