Hello Soufron, I just found out that I am a member of the Juriwiki mailing list. I was not aware that I was a member of that list, althougt I did state my interest in legal matters some time ago. I have never received e-mails from this mailing list, which leads me to the question wheter I indeed am a member of this mailing list (what I would like very much), or that my name just popped up in the summing up on Juriwiki mailing list? Usage rétroactif abusif d'une licence "Domaine public" sur Wikinews[edit]
Certains ont vraiment abusé en la matière. Prenant prétexte des conversations tenues ici ou là avec diverses personnes (participants de Wikinews ou de la Foundation), ils ont estimé que les textes publiés antérieurement au 24 septembre 2005 sur les projets Wikinews devaient être placés d'autorité dans le domaine public.
Il en a résulté, le 1er octobre sur WN-FR, la création d'un modèle:Article Domaine Public, qui a été apposé sur plein de pages dont 79 des articles dont je suis le premier (et principal) contributeur.
Quand on voit en plus comment de quelle manière sale ce modèle était apposé au sein de l'article, on ne peut qu'être effaré. Voir par exemple l'article Les électeurs néerlandais disent à leur tour « non » à la Constitution européenne dans sa version du 3 juin puis dans celle du 1er octobre.
Constatant cela, et pleinement conscient qu'on s'était livré à mon insu à une opération illégale, puisque je n'ai à aucun moment signé le moindre document écrit qui permette de transférer, comme on a pu me le dire entre-temps, mon droit moral d'auteur à une prétendue personne morale (sans existence) Wikinews, qui deviendrait ainsi auteur collectif des œuvres publiées avant le 24 septembre, j'ai :
- ajouté sur WN-FR une copie du fr:modèle:Double licence ;
- ajouté à ma page utilisateur Wikinews une revendication claire et nette de la double licence pour l'ensemble de mon travail passé et à venir ;
- supprimé, dans tous les articles dont j'étais le premier auteur (et principal contributeur), cette aberration du « domaine public » avec à chaque fois, dans la boîte de Résumé, ce commentaire explicite : « retrait de {{Article Domaine Public}}, qui viole le CPI ».
Ça n'a pas manqué de provoquer diverses réactions, chez un ignorant, le sieur Divol, qui a commencé par écrire n'importe quoi, et auquel j'ai répondu assez sèchement
Le sieur Faager ayant entre-temps manifesté l'intention de reverter l'ensemble de mon travail de revendication de licence, je demande le désysopage immédiat de ce personnage, en raison de sa violation caractérisée du droit d'auteur sur 79 articles, inaliénable selon le code de la propriété intellectuelle, la position d'administrateur me semblant incompatible avec la violation de ce droit.
Si la Foundation donne raison à ce personnage, il est clair que je cesserai toute collaboration avec elle, en me réservant le droit de faire appliquer le droit par toutes les voies qui pourraient me sembler nécessaires.
Contacté sur IRC, Solensean a alerté Jimmy Wales, lequel semblerait donner raison aux partisans de cette aberrante licence domaine public rétroactive. Là, je dis non, de toutes mes forces, et me mets en grève illimtée sur l'ensemble des projets dépendant de la Foundation. On ne passe pas ainsi par pertes et profits le droit d'un auteur à être en permanence crédité de son travail, puisqu'attribuer à la pseudo-personne Wikinews ce travail reviendrait à cela. Où va-t-on avec de telles dérives ?

- Juste pour dire, que je ne l'ai pas fait, et que je me renseigne avant - cette demande de desysopage est donc ridicule : je n'ai RIEN reverté contrairement à l'action prise par Hégésippe qui n'avait rien de démocratique (retrait du bandeau sans demander).

Mais... Hégésippe... jusqu'à septembre, tout le contenu de wikinews etait effectivement sous Domaine Public... Ce n'était pas un secret. C'était fait exprès pour pouvoir facilement se décider pour une licence ou une autre, ce qui a été fait depuis. Euh... que dire ?

Someone has registered this domain, but doesn't appear to be doing much with it. I'm thinking that we could contact them with a view to creating a New Zealand Wikipedia portal like www.wikipedia.ch.

Hi, Jean-Baptiste.
We need your advise to the matter connected with the usage of this template. Please check the discussions on en:Template talk:PD-USSR and en:Wikipedia:Requests for comment/Lupo. It is extremely unfortunate that the discussion became over-emotional and led to the personal accusation against Lupo, who certainly has acted in good faith, but the question is IMHO extremely important. We are talking about ~3000 images on English Wikipedia and Commons, not including the other wikis. It is thousands (maybe tens of thousands) of articles that could be possibly defaced. Many users, me included, feel very strongly about the matter. So far I personally feel like go from the wiki if the tag will go.
I personally do not see the compelling reasons to remove the tag. We never had a single complaint over it, pre-1973 Soviet works are routinely considered public domain by many Western publishers and I am not aware about any test cases in this matter. Maybe we could negotiate some sort of tightening the wording of the tag. If the Georgian 1991 declarations are the main concern we could temporarily stop uploading the images first published in Georgian SSR. We certainly should prevent abusing of the tag - if a Salvador Dali album was printed before 1973 in the Soviet Union it should be considered a pirated publications on the West, not the reason to put the reproductions, etc. But in my humble opinion total removing or depreciating of the tag would be a gross over-reaction until a clear-cut test case will be decided one way or the way.
I think the case is very important. You can count on the support of numerous Russian, Ukrainian, Belorussian, Armenian, Azerbaijani, Georgian and other xUSSR editors if you need some sort of research or translation. Question concerning Ukranian copyrights (and international copyright exemptions in general)[edit]
There seems to be growing questions in the English Wikipedia concerning images such as this one, which is from Ukraine, in which I believe sports logos are in the public domain due to to being a symbol of an organization. However, people seem to be unsure of whether the means that the image can be used freely in Wikipedia, as that would involve the servers based in Florida where such copyright exemptions might not apply. So, basically, I'm asking whether images that are public domain in countries other than the United States that would otherwise be under fair use, such as sports team logos, remain public domain in Wikipedia. Public domain in Italy[edit]
Hello, could you have a look at this debate on the Commons? We are about to get a tag claiming that images commissioned by the Italian state (and, in extension, by private academies and non-profit organisations) enter the public domain 20 years after publication. This understanding might be incorrect and thus dangerous to the project and our users, since we might introduce stealth non-free content to the Commons. Could you give us your comment? My name is Artur Piotr Wewióra. I have made my Master of Laws' degree at University of Łódź in 2002. I am a member of Polish local chapter (Stowarzyszenie Wikimedia Polska). Recently I have passed state judicial exams and now I work as an legal assistant to the President of Commercial Division of District Court for Łódź-Śródmieście in Łódź. In vast area of law I am especially interested in constitutional and commercial law, legal aspects of non-profit organisation's activities and also common law systems as opposite to continental (civil) law.
