ウィキメディア財団職員ならびに契約職員はボランティアのコミュニティと共にこのページの内容の保守に取り組みます。

法務部門とはウィキメディア財団 職員が属する部門のひとつです。その代表は顧問弁護士Stephen LaPorteが努めます。法務チーム（Legal Team）ならびにコミュニティ回復力・持続可能性担当をその下位に置きます。

法務部門

非営利団体501(c)(3)ウィキメディア財団はウィキペディアをふくめたくさんの他のウィキメディア・プロジェクト群をホストし運営しています。 顧問弁護士Stephen LaPorteのもと財団関連のすべての法的事項を監督する法務部門は、財団の目標と価値観に合致するコミュニティをサポートする主要なイニシアティブに集中して取り組みます。 私たちは広範な問題とプロジェクトを扱い、それには方針案作成、商標と著作権法、国際法、雇用法、訴訟、寄付行為と補助金法、国内・国際契約、個人情報保護法、道徳規範、インターネット関連法、非営利企業統治を含みます。

注記：法的・倫理的理由により当部門の弁護対象はウィキメディア財団に限定され、コミュニティや運動関連組織の弁護士となることはできませんが、法務チームはウィキメディア財団の目標に合致する様々な形でコミュニティに強力な支援を提供することがしばしばあります。

Global Advocacy

The Global Advocacy team helps the Foundation and affiliates protect the free knowledge movement through advocacy and public policy. The simple act of sharing knowledge freely online is radical and challenging in many contexts, and can be threatened by weak or hostile policy environments. This is why the Foundation and broader community engage in advocacy and public policy work. We work alongside the Wikimedia community because policy change is most successful when informed by those who are most directly impacted and best understand their local context. Together, we stand for policies that support and protect the Wikimedia model, its people, and its values.

Legal Affairs

Through our 3 subteams – Governance & Risk, Legal Operations, and Privacy & Compliance –, we build and defend our trademark portfolio to promote and protect the brand that the communities built, we support our global fundraising strategy to ensure revenue for the Wikimedia mission, we negotiate and approve hundreds of contracts every year that promote the mission, we ensure that the Foundation’s activities are carried out in accord not only with applicable law, but also with our Foundation policies, and movement and organizational values, we fight aggressively to protect our movement values and we provide daily support to the communities and their work.

方針

方針	説明
利用規約	この文書は、読者と利用者に、権利と責任範囲を含め、WMFの様々なプロジェクトが提供するものを通知しています。
プライバシー・ポリシー	このガイドラインは、プロジェクトやコミュニティとの関係でウィキメディア財団がサーバに収集した個人特定可能な情報をウィキメディア財団がどう取り扱うかを統制します。
寄付者に対するプライバシー方針	この方針は、WMFの寄付者の個人情報に対する取り扱いを示します。
法的方針	これらの方針はウィキメディア財団のOffice of the General Counselが広範囲なトピック、例えば、適用法、編集責任、DMCA（デジタルミレニアム著作権法）による削除、企業秘密、児童ポルノ、フェアユース、ハラスメント、召喚状、商標ライセンスなど、に取り組む場合の指針となります。

法務費用援助制度	この方針は法務費用援助制度の適用範囲として、ウィキメディアのウェブサイトまたはプロジェクトを問わず、サポート役として時間と労力を費やすウィキメディアコミュニティの適格なメンバーの援助を目的とします。
事務局行動の方針	この方針はウィキメディア財団の裁量のもと、コンテンツに公式な変更を加える場合、それを行う財団事務局を統治します。対象は抗議を受けた場合に、疑問視されるまたは法に従わないウィキメディアのコンテンツの削除に適用されます。
商標方針	この文書は、WMF（ウィキメディア財団）の商標の利用に関するWMFの方針の概略を示しています。
ビジュアルアイデンティティのガイドライン	これらのガイドラインは、ウィキメディア財団のマークを表示させる場合に固有の必要条件と制約条件を含みます。

法務の近況

法務部門は以下の空間で告知による情報更新または法務関連の問題について事前の協議を行うことがあります。

• Subscribe to the Wikimedia Public Policy mailing list for updates on legal actions, as well as other legal and public policy discussions.
• Wikimedia Blog posts categorized under "Legal" deliver important announcements to the community on new Legal initiatives, legal rulings involving Wikimedians around the world, and other legal or governance issues that may be of interest to the Wikimedia community.
• Wikilegal includes preliminary ideas and research notes on potential legal issues that may be relevant to the Wikimedia community’s mission to share free knowledge. Wikilegal is a stub to encourage community input and improvements.

デジタルミレニアム著作権法（"DMCA"）の法令遵守

DMCA 方針に加え、ウィキメディア利用規約第8条の次の規定をご参照ください。

The Wikimedia Foundation wants to ensure that the content that we host can be re-used by other users without fear of liability and that it is not infringing the proprietary rights of others. In fairness to our users, as well as to other creators and copyright holders, our policy is to respond to notices of alleged infringement that comply with the formalities of the Digital Millennium Copyright Act (DMCA). Pursuant to the DMCA, we will terminate, in appropriate circumstances, users and account holders of our system and network who are repeat infringers.

However, we also recognize that not every takedown notice is valid or in good faith. In such cases, we strongly encourage users to file counter-notifications when they appropriately believe a DMCA takedown demand is invalid or improper. For more information on what to do if you think a DMCA notice has been improperly filed, you may wish to consult the Chilling Effects website.

If you are the owner of content that is being improperly used on one of the Projects without your permission, you may request that the content be removed under the DMCA. To make such a request, please email us at legalwikimedia.org or snail mail our designated agent at this address.

Alternatively, you may make a request to our community, which often handles copyright issues faster and more effectively than prescribed under the DMCA. In that case, you can post a notice explaining your copyright concerns. For a non-exhaustive and non-authoritative list of the relevant processes for the different Project editions, look here. Before filing a DMCA claim, you also have the option of sending an email to the community at infowikimedia.org.
