Is this a copyright violation?

I don't really know, but aren't most lyrics copyrightable, at least in the United States where these servers are? I know that in the United States, what is copyrightable is a "creative work" or "original authorship." The lyrics to Hotel California are definitely both of those. Then, if I am correct, this would be a derivative work. But the lyrics to Hotel California are certainly not licensed under the GFDL. And thus this could be only be used under w:fair use, which would be a paltry and bald claim, considering that there is no "critical commentary." True. According to the English-language Wikipedia article, Weird Al had to get licensing permission from the artists and the labels to produce his work. Does that apply here? --Iamunknown 00:25, 11 March 2007 (UTC)Reply

Recording the song???

Keeping in mind that IANAL, here's what I understand:

  • The actual music is copyrighted, and could not be disseminated on Wikimedia.
  • The lyrics to the original song (Hotel California) are copyrighted, and could not be disseminated on Wikimedia.
  • The lyrics to the parody do not fall under the "derivative works" clause, and, as they were posted on Wikimedia (and originally on the English Wikipedia), they are released under the GDFL and can be disseminated on Wikimedia.
