Copyright on X rays images[edit]

The new Copyright Compendium, third edition, still in public draft, which is or will be the guidelines used internally by the US Copyright Office (Chapter 300), includes "Medical imaging produced by x-rays, ultrasounds, magnetic resonance imaging, or other diagnostic equipment" on their list of things they won't register (section 306).--Prosfilaes (talk) 18:45, 20 August 2014 (UTC)[reply]

The United States Copyright Office only says things about the United States. On Commons, images also have to be free in the country of origin, and the copyright office doesn't say anything about other countries. --Stefan2 (talk) 23:02, 27 August 2014 (UTC)[reply]

United States[edit]

As per Compendium: Chapter 300 by the US Copyright Office, "the Office will not register works produced by a machine or mere mechanical process that operates randomly or automatically without any creative input or intervention from a human author." including "Medical imaging produced by x-rays, ultrasounds, magnetic resonance imaging, or other diagnostic equipment." I therefore think we can safely tag medical imaging taken in the US as Public Domain. We keep that Public Domain status even if there would be some other country out there where the US image would be copyrightable just as with other US-based rationales. Thus, I've now requested the creation of a Public Domain tag for medical imaging taken in the US: Commons:Village_pump/Copyright#Creating {{PD-US-Medical imaging}}. Model release - medical photos and more - legal review - WMF grant proposal[edit]

I am seeking comments and hopefully endorsements on a draft request to the Wikimedia Foundation for grant funds. If you like, please comment at Grants:PEG/Wikimedia New York City/Legal review and templates for model release.

For some time I have been collecting examples in Wikimedia projects in which there is some disagreement about whether an image violates personality rights and would require a model release to host in Wikimedia Commons. See examples in the discussion sections at Grants_talk:PEG/Wikimedia_New_York_City/Development_of_a_model_release_process_for_photos_and_video.
